The JIA HAI KE 7 is only 37.84 nautical miles from Itbayat, Batanes. Under Article 56 of UNCLOS, the coastal State — the Philippines — holds sovereign rights and jurisdiction over its EEZ, including marine scientific research. Under Article 246, CONSENT from the Philippines is required before conducting MSR in our EEZ. No permit. No consent. China has no jurisdiction here.
Remember this: Batanes isn’t even inside your own illegal and fabricated nine-dash line — which was already struck down by the 2016 Arbitral Award. And now, you want to extend it all the way to the Luzon Strait?
And don’t try to fool us with “normal navigation.” A normal vessel doesn’t spoof its AIS position, doesn’t loiter over a submarine cable corridor, and responds to radio challenges. The JIA HAI KE 7 did the exact opposite of all that.
